Ceļu satiksmes noteikumu un transportlīdzekļu ekspluatācijas noteikumu pārkāpšanas kvalifikācija

Abstract

Diplomdarba tēma „Ceļu satiksmes noteikumu un transportlīdzekļu ekspluatācijas noteikumu pārkāpšanas kvalifikācija” izstrādāta ņemot vērā teorijas un prakses vajadzības. Noziedzīgs nodarījums, kas ir paredzēti Krimināllikuma 260.pantā tika izvēlēts par galveno pētījuma priekšmetu, jo tas visvairāk apdraud transporta kustības drošību, un tiesu praksē tiek piemērots visbiežāk. Darbā dota Krimināllikuma 260.panta sastāva krimināltiesiskā analīze. Tiek runāts par problēmām, kas pastāv kvalificējot noziedzīgu nodarījumu par Ceļu satiksmes noteikumu un transportlīdzekļu ekspluatācijas noteikumu pārkāpšanu, kā rezultātā ir iestājušās krimināllikumā minētās sekas. Darba autore, izvērtējot praktisko pieredzi, teorētiskos aspektus, ārvalstu likumdošanu un tiesu praksi, norāda uz Krimināllikuma normu trūkumiem, kas saistīti ar KL 260.panta kvalifikāciju un piedāvā priekšlikumus normu papildināšanai. Ievadā tiek dots pētījuma pamatojums un aktualitāte, kā arī sniegti statistiskie dati par noziedzīgiem nodarījumiem pret ceļu satiksmes drošību. Darba pirmajā nodaļā aprakstīts ceļu satiksmes noteikumu un transportlīdzekļu ekspluatācijas noteikumu vispārīgs raksturojums, tiek skaidrota atsevišķu terminu izpratne. Darba otrajā nodaļā – aplūkots noziedzīga nodarījuma pret ceļu satiksmes noteikumu un transportlīdzekļu ekspluatācijas noteikumu pārkāpšanas objektīvo pazīmju kopums (tiek aprakstītas noziedzīga nodarījuma objekts un noziedzīga nodarījuma objektīvā puse). Trešajā nodaļā – Ceļu satiksmes noteikumu un transportlīdzekļu ekspluatācijas noteikumu pārkāpšanas subjektīvo pazīmju kopums (noskaidrots noziedzīga nodarījuma subjekts, analizēta noziedzīga nodarījuma subjektīvā puse). Ceturtajā nodaļā tiek apskatīts ārvalstu regulējumus. Kopsavilkumā, ievērojot ārvalstu un Latvijas mūsdienu pieredzes apkopojumu, doti teorētiski pamatoti piedāvājumi un rekomendācijas sakarā ar Krimināllikuma pilnveidošanu saistībā ar minēto noziedzīgo nodarījumu. Darba izstrādes gaitā tika izmantotas dažādas pētījuma metodes; autore analizēja teorētisko literatūru un publikācijas, tiesu praksi; autore izmantoja savu prakses pieredzi Valsts policijas Rīgas reģiona pārvaldes Kārtības policijas pārvaldes Satiksmes noziegumu izmeklēšanas birojā, un pauda savu viedokli jautājumos, kas saistīti ar noziedzīga nodarījuma kvalifikāciju saskaņā ar Krimināllikuma 260.panta.

The bachelor’s thesis “The qualification of the offending of traffic regulations and vehicle exploitation regulations” has been made considering theoretical and practical needs; in this case criminal offence as specified in Article 260, Penal law of Latvia was chosen as the main subject of the research, because it is considered to be the main danger to road traffic and it has been met most often met in courts. Problems of the qualification of crime related to the offending of traffic regulations and vehicle exploitation regulations resulting in consequences as stated in Penal law of Latvia are discussed within this thesis. Substantiation and urgency of the research as well as facts of statistics of the criminal offences against the road safety are given in Introduction of this thesis. The first chapter of the thesis includes general information of the traffic regulations and vehicle exploitation regulations and explanation of comprehension of particular terms. The second chapter of the thesis includes description of totality of objective indications related to the offending of traffic regulations and vehicle exploitation regulations (object and the unprejudiced part of the criminal offence have been described). The third chapter of the thesis includes description of totality of subjective indications related to the offending of traffic regulations and vehicle exploitation regulations (subject and prejudiced part of the criminal offence have been described). The fourth chapter of the thesis includes review of legal framework in foreign countries. Analysis of legal provisions of the Penal code of Latvia providing road traffic safety guarantees through criminal law and comparison to the legal framework in foreign countries have been carried out within this thesis. Situations and problematical matters related to the qualification of the criminal offences according to the Article 260, Penal law of Latvia also have been analyzed within the thesis. Evaluating her practical experience, theoretical aspects, legal framework and jurisprudence of foreign countries the author of this thesis points at shortcomings in Penal law of Latvia and offers proposals for the improvement of Chapter XXI of the Penal law of Latvia. Following the pooling of experience of the foreign countries and Latvia the conclusion section of the thesis includes theoretically justified offers and proposals related to the update of the Penal law of Latvia, particularly in section regarding the criminal offences mentioned above. Different research methods have been used developing this thesis: author has carried out analysis of theoretical literature and publications, jurisprudence; used her own experience from working practice in the State Police, Riga region department, Public Order Police Department, Traffic Criminal Investigation Bureau. Author has also expressed her own opinion on matters related to qualification of the criminal offences according to the Article 260, Penal law of Latvia.
