Autore darbā apskata laulībā dzimušo bērnu un bērnu, kas nav dzimuši laulībā, civiltiesiskā statusa noteikšanu un ar to saistītās problēmas. Bakalaura darba mērķis ir analizēt Latvijas Republikas normatīvos aktus, kas regulē laulībā dzimušo bērnu un bērnu, kas nav dzimuši laulībā, civiltiesisko statusu, noskaidrot, kas ir kopīgs un, kas atšķirīgs šiem statusiem. Izanalizēt, kā statusa noteikšana un tiesības tiek regulētas Latvijas Republikā, Lietuvā, Igaunijā, Zviedrijā, Somijā, Anglijā, Amerikas Savienotās Valstīs, Ungārijā, Ukrainā un Spānijā. Darba gaitā tika izmantotas sekojošas zinātniskās pētniecības metodes: aprakstošā metode un salīdzinošā metode, salīdzinot tiesību atšķirības un statusa noteikšanu starp laulībā un ārlaulībā dzimušajiem bērniem.
Bakalaura darbā apskatītas vecāku un bērnu savstarpējās saistības, paternitātes un bērna izcelsmes noteikšana, kā arī apstrīdēšana un uzvārdu piešķiršana atbilstoši bērna izcelsmei.
Pētot un apskatot šos jautājumus, darba autore analizējusi tēmai atbilstošo juridisko literatūru, normatīvos aktus, kā arī tiesu praksi. Analizējot normatīvos aktus, autore ir secinājusi, ka bērnu tiesības un intereses tiek aizstāvētas ļoti plaši gan Latvijā, gan starptautiskā mērogā. Latvijā normatīvo aktu regulējums vēl nav pietiekams un tas ir nepilnīgs, lai regulētu bērna izcelšanās noteikšanā un apstrīdēšanā visu iesaistīto personu intereses.
Bakalaura darbs sastāv no ievada, četrām nodaļām un kopsavilkuma. Pirmajā darba nodaļā ir aprakstīta jēdziena “bērns” vispārējā izpratne. Otrā nodaļa ietver informāciju par laulībā dzimušo bērnu civiltiesiskā statusa noteikšanu. Trešā nodaļa veltīta bērnu, kas nav dzimuši laulībā, civiltiesiskā statusa noteikšanai. Tā iedalīta divās apakšnodaļās: paternitātes brīvprātīga atzīšana un paternitātes noteikšana tiesas ceļā. Bet ceturtā nodaļa veltīta laulībā un ārpus laulības dzimušo bērnu tiesībām uz mantojumu. Kopsavilkumā autore iekļāvusi savu redzējumu pastāvošo problēmu risinājumam. Author of the Bachelor’s paper inquires into problems related to the determination of the civil status of children that are born in marriage and out of wedlock. Objective of the Bachelor’s paper is to analyze laws and regulations of the Republic of Latvia that controls civil status of the children that are born in marriage and out of wedlock and to clarify similarities and differences in them. Author of the work analyzes how determination of the status and rights are regulated in the Republic of Latvia, Lithuania, Estonia, Sweden, Finland, England, United States of America, Hungary, Ukraine and Spain. To compare differences in the rights and in the process of status determination for children that are born in marriage and out of wedlock author uses following research methods: descriptive and comparative method.
Bachelor’s paper deals with mutual commitment between children and parents, determination of paternity and origin of child as well as challenge and concession of the surname in compliance with origin of the child.
In order to explore and consider these problems author of the work has analyzed legal literature, laws and regulations and jurisprudence related to the problem. Analyzing laws and regulations author came to conclusion that rights and interests of children are widely represented both in Latvia and internationally. Laws and regulations in Latvia still are not satisfactory and deficient to regulate interests of all persons involved in determination and challenge of children origin.
The Bachelor’s paper consists from introduction, four chapters and summary. The first chapter concerns to general comprehension of the term “child”. Second chapter gives information about determination of civil status of children that are born in marriage. Third chapter describes determination of civil status of children that are born out of wedlock. This chapter has two subsections: voluntary admission of paternity and determination of paternity by court. Fourth chapter concerns to rights of inheritance of children that are born in marriage and out of wedlock. In the summary author of the work gives opinion on solution of existing problems.
