Paternitātes apstrīdēšana un pierādījumu pieļaujamība un attiecināmība

Abstract

Temats tika izvēlēts, pastāvot minētā temata aktualitātei, jo paternitāte ir svarīga loma katra cilvēka dzīvē. Paternitātes apstrīdēšanā pastāv vairākas problēmas, pirmkārt, personu loks, kas var apstrīdēt paternitāti, šobrīd pastāvošais regulējumus neparedz iespēju apstrīdēt paternitāti bērna bioloģiskajam tēvam, otrkārt, termiņi, kādos bērns var apstrīdēt paternitāti ir ļoti ierobežoti, šādā veidā ierobežojot iespēju noskaidrot objektīvo patiesību par bērna bioloģisko izcelšanos. Treškārt, pierādījumu pieļaujamības un attiecināmības izvērtēšana, spriežot lietu pēc būtības. Pētījuma mērķis ir analizēt pastāvošo tiesisko regulējumu un esošās problēmas tiesu praksē. Pētījuma rezultātā autore piedāvā priekšlikumus normatīvo aktu pilnveidošanai paternitātes apstrīdēšanas lietās pastāvošo problēmu risinājumiem.

Theme was chosen, there is the topic covered since paternity has an important role in human lives. Paternity contesting a number of problems, first, the circles can contest paternity now, the existing framework does not allow the opportunity to contest paternity of the child's biological father, second, the time limits for disput paternity, child periods within which the child can contest paternity is very limited in this way limiting the possibility to find an objective appreciation of the child's biological origin, third, evidence admissibility and relevance of the evaluation of judging the metter. The study aims to analyze the existing legal framework and the problems in judicial practice. Study, the author offers proposals for improvement of regulatory enactments contesting paternity in cases of the problem solutions.
