Autore bakalaura darbā „Cietušais kriminālprocesā” aplūko cietušā institūtu Latvijā un ar to saistītās problēmas.
Darbā autore atspoguļo cietušā jēdziena vēsturisko attīstību un cietušā jēdzienu mūsdienu izpratnē. Īpašu uzmanību pievērš cietušā procesuālā statusa iegūšanas īpatnībām Latvijas Republikas kriminālprocesā.
Detalizēti un plaši autore atspoguļo cietušā tiesību vispārīgos principus, kā arī cietušā tiesības dažādās kriminālprocesa stadijās. Plaši analizē cietušā pienākumus un atbildību. Darbā sniegts ieskats par cietušā tiesībām uz morālās un materiālas kompensācijas gūšanu, kā arī cietušā tiesībām izlīgt ar personu, kura radījusi viņam kaitējumu. Autore norāda uz pozitīvajiem aspektiem – svarīgākajiem grozījumiem Kriminālprocesa likumā, kas novērsuši būtiskus trūkumus cietušā interešu aizsardzībā.
Autore analizē kriminālprocesuāls tiesību normas un pievērš uzmanību aktuālākajiem problēmjautājumiem, trūkumiem un nepilnībām, kas saistīti ar cietušā institūtu Latvijas Republikas kriminālprocesā, kā arī sniedz savu redzējumu trūkumu novēršanā. The author of given bachelor’s paper “Victim in criminal process” deals with the institution of the crime victim in Latvia and the problems concerning it.
In the given work the author displays the historic development of the concept of the crime victim and the concept of the crime victim in modern understanding. Special attention has been paid to the peculiarities of obtaining the procedural status of the crime victim in the criminal procedure in the Republic of Latvia.
The author reveals the basic principles of the rights of the crime victim as well as the rights of the crime victim in different stages of the criminal procedure in a detailed and wide way. The author presents a wide analysis of the duties and responsibilities of the crime victim. The work gives an insight into the rights of the crime victim to obtain moral and material compensation as well as the rights of the crime victim to reconcile with the person who has caused damage for him. The author draws attention to the positive aspects – the most important changes in the Criminal Law which have prevented essential imperfections in the defense of interests of the crime victim.
The author analyses the rules of the criminal procedure and pays attention to the most topical problem questions, drawbacks and imperfections connected with the institution of the crime victim in the criminal procedure of the Republic of Latvia, as well as gives her vision referring the prevention of the drawbacks.
