Neatļautu darbību ar narkotiskām un psihotropām vielām krimināltiesiskais aspekts

Abstract

Bakalaura darba tēma - „NEATĻAUTU DARBĪBU AR NARKOTISKĀM UN PSIHOTROPĀM VIELĀM KRIMINĀLTIESISKAIS ASPEKTS”. Darba mērķis – aplūkot un izpētīt neatļautu darbību ar narkotiskām un psihotropām vielām krimināltiesiskos aspektus, kā arī noskaidrot tiesiskā regulējuma nepilnības un problēmas šajā jomā gan Latvijā, gan ārvalstīs. Lai sasniegtu nosprausto darba mērķi, autore izvirzīja sekojošus darba uzdevumus – apskatīt no vēsturiskā viedokļa kriminālatbildības par narkotisko un psihotropo vielu nelegālu apriti attīstību; izpētīt narkotisko un psihotropo vielu nelegālas aprites kā noziedzīga nodarījuma sastāvu; apzināt kvalifikācijas īpatnības; izpētīt kriminālatbildības regulējumu narkotisko un psihotropo vielu nelegālai apritei ārvalstu Krimināllikumos. Nospraustā mērķa sasniegšanai darbs veidots no trijām nodaļām. Pirmajā nodaļā apskatīta kriminālatbildības par narkotisko un psihotropo vielu nelegālu apriti vēsturiskā attīstība kā ārvalstīs tā Latvijā. Otrā nodaļa veltīta narkotisko un psihotropo vielu nelegālas aprites krimināltiesiskā aspekta izpētei, proti: apskatot gan noziedzīga nodarījuma sastāvu, gan kvalifikācijas īpatnības praksē. Darba trešā nodaļa veltīta kriminālatbildības regulējuma narkotisko un psihotropo vielu nelegālai apritei ārvalstu Krimināllikumos, apskatam. Darba kopsavilkumā autore izvirzīja aizstāvēšanai tēzes, balstoties uz darbā apskatītajiem jautājumiem. Darbs sastāv no 89.lpp.

The summary Theme of work - "Criminal-legal aspect of not resolved actions with narcotic and psychotropic substances”. The work purpose - to consider and study criminal-legal aspect of not resolved actions with narcotic and psychotropic substances, and also to find out lacks and problems of legal regulation in this area as in Latvia, and abroad. To reach an object in view, the author puts forward following work problems - from the historical point of view of criminal responsibility to consider development of an illegal turn of narcotic and psychotropic substances; to study an illegal turn of narcotic and psychotropic substances as criminal act structure; to distinguish regulation of criminal responsibility of a turn of narcotic and psychotropic substances in foreign Criminal Laws. For achievement of an object in view work is created from three parts. In the first part development of criminal responsibility of an illegal turn of narcotic and psychotropic substances as abroad, and in Latvia is considered historical. The second part is devoted research of criminal-legal aspect of an illegal turn of narcotic and psychotropic substances, namely: considering both criminal act structure, and features of qualification in practice. The third part is devoted consideration of regulation of criminal responsibility of an illegal turn of narcotic and psychotropic substances in foreign Criminal Laws. In the termination of work the author puts forward theses to protection, leaning against the questions considered in work. Work consists from 89 pages.
