Darba mērķis ir analizēt militārpersonu tiesības salīdzinājumā ar citu amatpersonu tiesībām, konstatējot būtiskās atšķirības un izvērtējot to pamatotību saistībā ar Satversmes 91.pantā ietverto vienlīdzības principu. Darbs ir orientēts uz militārpersonu un citu amatpersonu sociālo tiesību analīzi un salīdzinājumu.
Pētījumā ir atspoguļoti juridiskajā literatūrā paustie viedokļi, militārpersonu un citu amatpersonu tiesības šobrīd regulējošās tiesību normas Latvijā un ārvalstīs, kā arī ar militārpersonu tiesībām saistītā tiesu prakse.
Autors darbā ir konstatējis problēmas, kuras pastāv nepilnīga normatīvā regulējuma dēļ.
Teorijas, tiesību normu un tiesu prakses analīzes rezultātā autors ir secinājis, ka atsevišķās jomās militārpersonu un arī citu amatpersonu tiesības ir nepamatoti ierobežotas.
Pētījuma nobeigumā ir piedāvāti priekšlikumi normatīvā regulējuma uzlabošanai un problēmu risināšanai. The aim of this work is to analyze the rights of military personnel in comparison with the rights of other officials, establishing essential distinction and appraising the validity of rights in connection with the principle of equality included in the Constitution of the Republic of Latvia (Chapter VIII, paragraph 91st). The research is focused on analyzing and comparing the social rights of military personnel and other officials.
The research reflects opinions expressed in law books, legal provisions which regulate the rights of military personnel and other officials in Latvia and foreign countries and judicial practice concerning military personnel.
The author establishes the problems which exist due to deficient normative regulations.
Analyzing the theory, legal provisions and judicial practice, the author has established that in some areas the rights of military personnel and other officials are unfoundedly restricted.
In conclusion of research the author offers the propositions regarding the improvement of normative regulations and solution of problems.
