Abstract
Administratīvās lietas, kas atbilst Eiropas Cilvēktiesību tiesas izvirzītajiem Engela kritērijiem, ir pielīdzināmas krimināllietām, tāpēc to izskatīšanā ir jāievēro sodu tiesībām raksturīgi uz adresāta aizsardzību vērsti principi. Bakalaura darbā pētīts, vai pastāvošais administratīvā procesa regulējums pietiekami nodrošina šo principu ievērošanu, pievēršoties noilguma institūtam un tiesībām sevi neapsūdzēt. Salīdzinošās analīzes rezultātā bakalaura darbā izvirzīti ieteikumi noilguma institūta regulējuma pilnveidošanai pēc ārvalstu modeļu parauga, kā arī pētīts, kādā mērā tiesības sevi neapsūdzēt administratīvajās tiesībās atzītas nacionālajās tiesību sistēmās un starptautisko cilvēktiesību normās.
Administrative proceedings meeting the Engel criteria established by the European Court of Human Rights are comparable to criminal proceedings and thus require compliance with principles of penal law aimed at the protection of the addressee. The bachelor's thesis examines whether the existing administrative proceedings framework sufficiently ensures compliance with these principles, addressing the institute of limitation period and the right to not incriminate oneself. As a result of comparative analysis, the bachelor’s thesis puts forward recommendations to improve the regulation of the institute of limitation in accordance with examples of foreign models, as well as examines the extent to which the right not to incriminate oneself in administrative law is recognized by national legal systems and international human rights law.
