Abstract
Maģistra darbā autors analizē taisnīguma jēdzienu, izpratni un veidus, kā arī to kolīzijas. Taisnīguma princips nav tikai deklaratīva tiesību ideja, kura ir tālu kaut netverama un neapjaušama, tas „dzīvo” tiesībās, ikvienā tiesību normā. Taisnīgums ir dabiski izcēlies no tautas gara un tās prāta.
Autors piedāvā taisnīguma izpratnes definīciju: taisnīgums ir tautas, valsts un ikviena tiesību subjekta saprātīgās izpratnes un apziņas, sociālo un ekonomisko labumu mēra vidusceļš, kurš dibina tiesiski stabilu, paredzamu un godīgu paļaušanos uz faktisko vai nākotnē sagaidāmo atrisinājumu.
Taisnīguma veidi ir iedalāmi pēc interesēm, objektīvajā un subjektīva un pēc resursu sadales sadalošajā un izlīdzinošajā taisnīgumā. Kaut arī objektīvais taisnīgums ir nostiprināts tiesību normās, tomēr ir gadījumi, kad tam nākas atkāpties subjektīvā taisnīguma priekšā. Ir svarīgi, lai sadalošā taisnīguma izvirzītajiem mērķiem pakļautos visi, pretējā gadījumā, resursu sadale nebūs taisnīga. Savukārt izlīdzinošajam taisnīgumam ir pilnībā jāizlīdzina nevienlīdzība vai pāridarījums.
Autors maģistra darbā aprobējis teorētiskās taisnīguma koncepcijas un piedāvā likumdevējam priekšlikumus, lai atrisinātu objektīvā un subjektīvā taisnīguma kolīzijas un sadalošā un izlīdzinošā taisnīguma realizēšanas problēmas, kuras autors ir konstatējis analizējot tiesu praksi.
In master’s thesis author analyzed the concept, types and forms of collisions of justice. The principle of justice is not only a declaration of law idea, that is so far elusive and not sensible, it “lives” in law in each rule of law. Justice is arising from the nation’s spirit and reason. Author offers the definition of justice: justice is nations, states and everyone’s law subject’s reasonable perception and midway measure of sense and social and economic benefits, that establish stable legal, predictable fair reliance to presently or prospective settlement. Types of justice are divided in two ways, based on interests – objective and subjective justice and based on distribution of resources – distributive and corrective justice. Though objective justice are fixed in rules of law, nevertheless there are cases in it must give way to subjective justice. It is important so as highlighted aims of distributive justice obey everybody otherwise distributive of resources will be not fair. In its turn corrective justice is fully reimburse inequality or injury. In master’s thesis author approbates theoretical concepts of justice and comes forward with proposals to legislature for solving the objective and subjective collisions of justice and realization problems of distributive and corrective justice, which has been found out during the analysis of jurisprudence.
