Vecāku saskarsmes tiesības ar bērnu un realizācija.

Abstract

Bakalaura darba tēma ir “Vecāku saskarsmes tiesības ar bērnu un to realizācija”, kas šobrīd ir aktuāla, jo arvien pieaug to tiesvedību skaits, kurās viens no bērna vecākiem lūdz tiesu noteikt saskarsmes tiesību kārtību ar bērnu. Darba mērķis ir izpētīt saskarsmes tiesību jēdzienu, tās regulējumu tiesību normās un vēsturisko attīstību, noteikt aktuālākos problēmjautājumus un ierosināt izmaiņas Latvijas normatīvajos aktos, lai tos risinātu. Lai sasniegtu darba mērķi, autore darbā aplūkojusi saskarsmes tiesību vēsturisko attīstību Latvijā, aplūkojusi un salīdzinājusi bērna un vecāku saskarsmes tiesību regulējošās normas vairākās ārvalstīs un salīdzinājusi tās ar Latvijas tiesību normām, kā arī sniegusi risinājumus darbā aplūkotajiem problēmjautājumiem.

Bachelor thesis topic is “Parental right of access to the child and its implementation”, which currently is actual as the number of litigation cases, in which one of the parents of the child asks the court to determine the procedure of access to the child, is increasing. The aim of the bachelors thesis is to identify the most urgent issues of right of access and give proposition to changes to Latvian legislation to deal with them by studying the concept of right of access, its legal regulation as well as historical development. In order to achieve the aim of the thesis, author studied the historical development of the right of access in Latvia, legislation of children and parental rights in several foreign countries and compared them with the law in Latvia as well as provided solutions to the issues recognized in thesis.
