Abstract
Promocijas darbs „Cilvēka dzīvības aizsardzības krimināltiesiskie aspekti" ir Latvijā pirmais
šāda apjoma komplekss teorētiski praktisks pētījums par cilvēka dzīvības krimināltiesisko
aizsardzību. Darba centrālā ideja ir cilvēka tiesības uz fizisko eksistenci jau no ieľemšanas brīţa un
dzīvības aizsardzību ar krimināltiesiskiem līdzekļiem, kas, pirmkārt izpauţas savas koncepcijas
izstrādē, kurā ietverta dzīvības un tiesības uz dzīvību satura, kā arī dzīvības robeţu noteikšana
tiesību uz dzīvību kontekstā, akcentējot nepieciešamību legāli definēt embrija un augļa (nasciturus)
tiesisko statusu un nodrošināt tā attīstības krimināltiesisko aizsardzību no jebkādas prettiesiskas
rīcības un iznīcināšanas, kas pamatots ar starptautisko tiesību aktu, daţādu zinātľu nozaru atziľu un
ārvalstu krimināltiesiskā regulējuma analīzi.
Otrkārt, pamatota nepieciešamība reglamentēt nedzimušas dzīvības krimināltiesisko
aizsardzību no vardarbīgiem apdraudējumiem un iespējamajām medicīnas, dzīvības zinātľu un
biotehnoloģijas sasniegumu praktiskās izmantošanas kaitīgajām sekām, paredzot Krimināllikumā
atbildību par noziedzīgiem nodarījumiem biomedicīnas ētikas jomā un ar teorētisko pētījumu
palīdzību nodrošinot šo tiesību normu pareizu izpratni un vienveidīgu piemērošanu praksē.
Krimināltiesību doktrīnas izpētes un Latvijas tiesu prakses analīzes rezultātā apzinātas
slepkavības kvalifikācijas teorētiskās un praktiskās problēmas, piedāvājot vadlīnijas un ieteikumus
identificēto problēmjautājumu risināšanai krimināltiesību normu piemērošanas praksē, kā arī,
ievērojot dzīvības aizsardzības krimināltiesiskā regulējuma vēsturisko pēctecību un citu valstu
pieredzi, izstrādāti priekšlikumi Latvijas krimināltiesiskā regulējuma pilnveidošanai dzīvības
aizsardzības jomā atbilstoši jaunākajām zinātnes atziľām un mūsdienu kriminogēnajām reālijām.
The promotion work "Criminal and Legal Aspects of Human Life Protection" is the first such volume complex theoretical and practical research in Latvia on the legal protection of human life. The main idea of the thesis is the human right for physical existence and human life protection by the Criminal Law. The central idea of the thesis is the human rights to the physical existence from the moment of conception and the life protection with criminally legal instruments, which, first of all, are expressed in the development of their conception including life and rights to the life content, as well as determination of life boarders within the context of rights to life, stressing the necessity to define the legal status of embryo and foetus and to provide the criminally legal protection of its development from any illegitimate activity and destruction that is justified by the international legislation, cognitions of different fields of science and analysis of foreign criminally legal regulation. Secondly, there is justified necessity to regulate the criminally legal protection of unborn life from the violent threats and possible harmful consequences of practical use of medicine, life science and biotechnological achievements, providing the responsibility in the Criminal Law for the crime in field of biomedical ethics and by help of the theoretical survey to provide the correct comprehension of these legal standards and homogenous application in practice. In the result of survey of criminal right doctrine and the analyses of Latvian court practice, there are studied the theoretical and practical problems of intentional murder qualification, offering the guidelines and offers for solution of the identified problem issues regarding application of criminal right standards in the practice, as well, as observing the historical succession of criminally legal regulation of life protection and the experience of other countries, there are developed recommendations for improvement of Latvian criminally legal regulation in sphere of life protection according to the current science cognitions and modern criminal objects.
