Abstract
Maģistra darbs „Aizdomās turētais kriminālprocesā” izskata jautājumus, kas saistīti ar šī institūta izpētīšanu kriminālprocesā. Šajā darbā izsmeļoši tiek noteikts kriminālprocesa dalībnieka - aizdomās turētā statuss un procesuālais stāvoklis, tā nozīme turpmākā tiesas izmeklēšanā, tiek iztirzāti tiesības un pienākumi, tiek doti piemērojamo drošības līdzekļu raksturojumi, kā arī dažādi nozīmīgie praktisko un psiholoģisko aspektu nosacījumi aizdomās turētā nopratināšanā.
Maģistra darbs sastāv no ievaddaļas četrām nodaļām un kopsavilkuma.
Maģistra darba mērķis ir aizdomās turētā tiesību un pienākumu, kas ir noteikti kriminālprocesā izpētīšana, kā arī to ievērošanas nozīmes veiksmīgai izmeklēšanas norisei kriminālprocesā noteikšana.
Maģistra darba nobeigumā ir izdarīti secinājumi par kriminālprocesa institūta pamatnoteikumiem, kā arī tiek piedāvāti iespējamie problēmu, kas rodas praktiskajā darbībā risināšanas virzieni. Šajā darba atspoguļotas Latvijas valsts un citu valstu autoru uzskati saistībā ar aizdomās turēta statusu kriminālprocesā. Šī darba izstrādes gaitā tika izmantoti dažādi normatīvie akti, zinātniskās literatūras avoti un praktiskie materiāli
Anotation The Master Paper on the theme “Suspected person in the criminal process” that highlights questions connected with the research of the institute in the field of procedural criminal law. The status and condition of the participant of the criminal process – of the suspected person, his importance for the trial, his rights and duties, characteristics of temporary measures that are applied to suspected person and several psychological aspects of interrogation of the suspected person are discussed in the Paper. The Master Paper consists of introduction, four chapters and conclusion The aim of the Master Paper was to research the rights and duties of suspected person and to examine what needs to be done to finish the investigation of the criminal process successfully. In the end of the Master Paper main conditions of the criminal process of the researched institute were put and possible solutions to the established problems were provided. The position of the Latvian and foreign authors was reflected in the Master Paper. Practical aspects and statistic of the law practice were widely used for creating this work.
