Inventāra tiesība un mantojuma invnetāra saraksta sastādīšana

Abstract

Bakalaura darba tēma ir “Inventāra tiesība un mantojuma inventāra saraksta sastādīšana”. Šobrīd notiek Latvijas mantojuma tiesību modernizācija, viens no būtiskākajiem grozījumiem ir ierobežot mantinieku atbildību pret mantojuma atstājēja kreditoriem, nosakot, ka turpmāk pastāvēs tikai viens mantinieku atbildības režīms līdzšinējo divu režīmu vietā. Tā kā mantojuma pieņemšana ar inventāra tiesību mantojuma tiesību reformas rezultātā kļūs par vispārīgu mantojuma tiesību principu, mantojuma inventāra saraksts jeb pēc mantojuma tiesību reformas realizēšanas mantojuma saraksts, kļūs par nozīmīgu sastāvdaļu katrā mantojuma lietā. Inventāra tiesība līdz šim ir bijusi pretrunīga, arī mantojuma inventāra saraksta sastādīšana ir bijusi problemātiska un maz regulēta. Pētījuma rezultātā sagatavoti secinājumi, kas apkopoti bakalaura darba kopsavilkumā.

The title of the bachelor’s thesis is “Inventory right and preparing of an inheritance inventory”. Currently modernization of inheritance rights in Latvia is underway. One of the most important amendments is to limit the liability oh heirs the creditors of the estate-leaver. As a result, instead of previous two regimes of liability of heirs in the future will exist only one. Since there will be only one regime and heirs will be able to accept the inheritance only with benefit of inventory, preparing of inheritance inventory list will become an important component in every inheritance matter. So far inventory right has been controversial and preparing of an inheritance inventory has been problematic and regulated poorly. The study has led to conclusions summarised in a summary of the bachelor’s thesis.
