Biometrijas datu izmantošanas drošības un migrācijas nodrošināšanai starptautiski tiesiskās prasības un to ieviešana Latvijas Republikā

Abstract

Darba mērķis ir izpētīt biometrijas datu izmantošanu drošības un migrācijas nodrošināšanai starptautiskajā un reģionālajā līmenī, apskatīt situāciju Latvijas Republikā attiecībā uz biometrisko datu un to apstrādes tiesiskā regulējuma ieviešanu, kā arī identificēt problēmjautājumus biometrijas datu izmantošanas tiesiskajā regulējumā un sniegt priekšlikumus tiesiskā regulējuma uzlabošanai starptautiskajā, Eiropas Savienības un nacionālajā līmenī. Darbā autors centās pievērst galveno vērību biometrijas datu tiesiskā regulējuma attīstībai Eiropas Savienības tiesībās un Latvijas Republikas nacionālajā likumdošanā. Ņemot vērā to faktu, ka Latvijas tiesību akti šajā jomā ir pavisam “svaigi”, šāda tiesību normu dinamiskās attīstības analīze ir nepieciešama gan Eiropas Savienības tiesību prasību izpildei, gan mūsu likumu un citu tiesību aktu pareizai iztulkošanai un piemērošanai, kā arī, nepieciešamības gadījumā, to saskaņošanai atbilstoši Eiropas Savienības prasībām.

The theme of this paper is "International legal requirements for use of the biometric data for ensuring of the security and migration and their implementation in the Republic of Latvia". This paper analyses the evolution and the current stage of the international, regional (European Union) legal instruments on the use of the biometric identifiers for the purposes of the state security and migration control as well as their implementation in the Republic of Latvia. The conducted analysis, which is reflected in this paper, identified main areas, in which the international and regional legal instruments on the use of the biometric identifier exists: passports and other travel documents, residence permits for certain categories of foreigners, identification of the certain categories of asylum seekers and illegal migrants, and outlined the future perspectives of the use of biometric identifiers at the European Union level for the purposes of the common visa policy. The legislative and practical achievements of the Republic of Latvia related to the implementation of these instruments and their application within Latvia’s legal system were examined and the legal gaps were identified. The paper identifies a number of legal problems arising in the field of the use of the biometric data and the needs for the improvement of the current regulation. The author concludes that although a number of the international and EU legal instruments already exists in this field, only the separate issues of migration and state security have been covered so far. The problems of the implementation of the above-mentioned European Union’s legal standards in Latvia are examined as well. The author initiates the proposals both for the amendments to the current legal regulation at the international and European Union level, and for the successful solution of the problems, which have been identified in the legislation of the Republic of Latvia.
