Imigrācijas likuma grozījumu, ciktāl tie paredz valsts valodas pārbaudes kārtošanu Krievijas Federācijas pilsoņiem, atbilstība cilvēka pamattiesību regulējumam

Abstract

2022. gada 22. septembrī tika veikti Imigrācijas likuma grozījumi, mainot pastāvīgās uzturēšanās tiesisko pamatu Krievijas Federācijas pilsoņiem un, pieprasot valsts valodas prasmes kārtošanu kā obligātu priekšnosacījumu pastāvīgai uzturēšanās Latvijas Republikā. Neskatoties uz to, ka šie grozījumi vēlāk tika divas reizes papildināti, nemainot to būtību, Satversmes tiesa 2023. gadā saņēma četras lietas par šo grozījumu neatbilstību Satversmes 1., 91. panta pirmajam teikumam un 96. pantam, kā arī Eiropas Cilvēktiesību un pamatbrīvību aizsardzības konvencijas 4. protokola 4. pantam. Darba mērķis ir izpētīt Imigrācijas likuma grozījumu, ciktāl tie paredz valsts valodas prasmes pārbaudes kārtošanu Krievijas pilsoņiem, atbilstību cilvēka pamattiesību regulējumam. Darbā ir izvirzīti uzdevumi izpētīt Latvijas migrācijas vēsturisko attīstību, aplūkot valsts valodas ģenēzi, analizēt Imigrācijas likuma grozījumu pieņemšanas procesu, izpētīt, vai līdzīgs regulējums ir pieņemts citās Baltijas valstīs, kā arī izvērtēt grozījumu atbilstību cilvēka pamattiesībām, izmantojot cilvēktiesību ierobežošanas shēmu. Darbā tiek secināts, ka Imigrācijas likuma grozījumi nav atbilstoši cilvēka pamattiesībām, jo nav piemēroti leģitīma mērķa – citu cilvēku tiesības – sasniegšanai, kā arī ir iespējami saudzējošāki veidi kā panākt nosprausto mērķi.

On September 22, 2022, the Immigration Law was amended, changing the legal basis of permanent residence for citizens of the Russian Federation and requiring proficiency in the national language as a mandatory prerequisite for permanent residence in the Republic of Latvia. Despite the fact that these amendments were later supplemented twice without changing their essence, in 2023 the Constitutional Court received four cases regarding the non-compliance of these amendments with Articles 1, 91,first sentance and 96 of the Constitution, as well as with Article 4 of the European Convention for the Protection of Human Rights and Fundamental Freedoms. to Article 4 of the protocol. The aim of the work is to study the compliance of the amendments to the Immigration Law, insofar as they provide for the passing of the state language proficiency test for Russian citizens, with human rights. The work sets out the tasks of researching the historical development of Latvian migration, examining the genesis of the national language, analyzing the process of adoption of amendments to the Immigration Law, investigating whether similar regulation has been adopted in other Baltic countries, as well as evaluating the compliance of the amendments with human rights using the human rights restriction scheme. The work concludes that the amendments to the Immigration Law are not in accordance with human rights, as they are not suitable for achieving the legitimate aim - the rights of other people - and there are possible more lenient ways to achieve the set goal.
