Abstract
Bakalaura darbā autore pēta cēloņsakarības noskaidrošanu un tiesisko regulējumu deliktu tiesībās gan Latvijā, gan ārvalstīs. Darbā tiek apskatīta cēloņsakarības būtība un nozīme civiltiesiskās atbildības noteikšanā, piemērojot testu Conditio sine qua non un ņemot vērā citus apstākļus. Ir analizēts arī vairāku cēloņu izraisīts kaitējums un šo cēloņu noskaidrošanas problēmjautājumi. Darbā ir analizēta ārvalstu un Latvijas tiesu prakse, cēloņsakarības tiesiskais regulējums, dažādu atzītu Latvijas un ārvalstu civiltiesību zinātnieku viedokļi. Analīzes rezultātā autore pauž savu viedokli. Autore izdara jaunas atziņas, piedāvājot savus ierosinājumus tiesiskā regulējuma pilnveidošanai un cēloņsakarības noskaidrošanai.
The Author of bachelor thesis clarifies the main criteria for establishment of causation and researches legal framework of Tort law in Latvia and other countries. The Author examines the matter and role of causation in the context of determination of civil liability by applying the test conditio sine qua non. There are also analyzed damages caused by multiple causes and determination problems of these causes. The Author examines foreign and Latvian case law in connection with the legal basis of causation. There are analysed different opinions presented by well-known Civil law scientists in these bachelor theses. It is necessary to establish normative basis of causation in Latvia. For this purpose, the Author offers her suggestions how the legal basis of causation could be improved.
