Abstract
Maģistra darba ietvaros ir pētīts un analizēts termiņš pieteikuma iesniegšanai Satversmes tiesā. Maģistra darba pirmajā nodaļā aplūkota procesuālā termiņa institūta izpratne procesuālajās tiesībās, analizēta Eiropas Cilvēktiesību tiesas prakse termiņa piemērošanā. Otrajā nodaļā pētīts termiņa konstitucionālās tiesas procesā tiesiskais pamats un nepieciešamība, kā arī salīdzinošās analīzes ietvaros vērtēta dažādu Eiropas valstu pieeja termiņa noteikšanā un piemērošanā. Pētījuma noslēdzošā nodaļa veltīta Satversmes tiesas prakses izpētei attiecībā uz termiņa noteikuma piemērošanu, īpaši uzsverot konstitucionālajai sūdzības iesniegšanai noteikto termiņu, kā arī aplūkota piemērošanas kārtība un kritēriji, konstatējot iespējamos problēmjautājumus un izdarot secinājumus par tiesību institūtu un tā iespējamo attīstību Satversmes tiesas procesā.
The Master’s thesis contains research on time limits determined for submitting an application to the Constitutional court of the Republic of Latvia. The introductory chapter deals with a legal basis of procedural time limits and the application of time limit as a procedural admissibility criteria by European Court of Human Rights. The second chapter contains comparative analysis of legal basis and the necessity of time limits for submitting different types of applications to the constitutional court in various European countries and their approach in determining and applying time-limit criteria. The concluding chapter examines case law of the Constitutional court of the Republic of Latvia regarding the time-limit rule with particular emphasis on time limit for submitting a constitutional complaint. Also current issues are being defined and conclusions drawn about the time limit as a legal institution and its potential development in the constitutional court proceedings.
