Pārrobežu mantojuma lietu vešana pie Latvijas notāra

Abstract

Maģistra darbs ir veltīts pārrobežu mantojuma lietu vešanas tiesiskā regulējuma analīzei no Latvijas notariāta skatupunkta un tajā ir izpētīti aktuālie problēmjautājumi Eiropas Savienības ietvaros, kas saistīti ar pārrobežu mantojuma lietu vešanu pie Latvijas notāra un kurus regulē Mantošanas regula. Maģistra darba mērķis ir izpētīt notāra lomu pārrobežu mantošanā, kā arī aplūkot iespējamos problēmjautājumus, ar kuriem notāri varētu saskarties, vedot pārrobežu mantojuma lietas un piemērojot Eiropas Savienības starptautisko privāttiesību normas. Darba ietvaros autore konstatē praksē pastāvošos problēmjautājumus, kas saistīti ar jurisdikciju, piemērojamo likumu, publiskiem aktiem un jaunieviesto starptautisko dokumentu – Eiropas mantošanas apliecību, un analizē nepilnības pārrobežu mantošanas tiesiskajā regulējumā, kā arī sniedz iespējamos risinājumus problēmjautājumu un trūkumu novēršanai.

The master thesis encompasses analysis of legal regulation of cross-border inheritance matters from the point of view of represetatives of the notary`s proffession in Latvia and examines current problematic issues within the borders of European Union, regulated by Succession Regulation - issues that arise when a cross-border inheritance matter is dealt by a notary in Latvia. The objective of this work is to examine the role of a notary in cross-border inheritance matters as well as consider the possible issues that a notary might come across when dealing with cross-border inheritance matters and applying the international private law of European Union. Within the thesis author establishes existing problematic issues concerned with jurisdiction, applicable law, public acts and the new international document – European Certificate of Succession and analyses imperfections within the legal regulation of cross-border inheritance as well as provides possible solutions for elimitation of problematic issues and drawbacks.
