Aizliegtas vienošanās jēdziens Konkurences tiesībās

Abstract

Konkurences tiesības Latvijā ir maz pētītas. Līdz ar dinamisko ekonomikas attīstību aizvien pieaug konkurences tiesību loma ekonomikā, tāpēc ir būtiski pētīt un analizēt konkurences tiesību jautājumus un ar tiem saistītās problēmas. Pētījumu rezultātā ir iespējams efektivizēt konkurences tiesību īstenošanu. Darbā ir pētīts horizontālo vienošanos aizliegums Latvijas konkurences tiesībās, īpaši vēršot uzmanību uz saskaņotas darbības un paralēlas uzvedības jēdzienu izpratni konkurences tiesībās, kā arī aizliegtas vienošanās nošķiršanu no tirgus dalībnieku paralēlas uzvedības. Latvijas konkurences tiesības ir veidotas, par pamatu ņemot ES konkurences tiesības, tāpēc tās nevar skatīt atrauti no ES konkurences tiesībām. Šī iemesla dēļ darbā ir pētītas Latvijas konkurences tiesības ES konkurences tiesību kontekstā.

Competition law has been researched modestly in Latvia. The significance of competition law is increasing along with the dynamic economical growth therefore it is essential to research and analyse the concerning issues. Such a study would make it possible to achieve efficient practice of the competition law. This paper studies the concept of the anti-conpetitive agreement in the competition law of Latvia particularly focusing on the analysis on concept of the concerted practice and parallel behavior of the market players, as well as anti-conpetitive agreement and parallel behavior of the market players separation. Since the competition law of Latvia originates from the competition law of the European Union, it cannot be investigated separately without referring to the competition law of the EU. Hence, in this paper the competition law of Latvia is studied against the background of the competition law of the EU.
