Nekustamā īpašuma domājamās daļas mantošana

Abstract

Problēmas būtība ir praksē iespējamās situācijas, kad nekustamā īpašuma domājamās daļas mantošanas laikā var tikt nepamatoti ierobežotas mantinieka kā jaunā kopīpašnieka tiesības. Pētījuma mērķis ir identificēt autores ieskatā būtiskākos šādus tiesību ierobežojošos gadījumus, lai rosinātu diskusijas un tiktu rasti risinājumi. Pētījuma uzdevums ir apzinātajām problēmsituācijām rast risinājumus, piedāvājot konkrētus grozījumus normatīvajos aktos. Pētījums izstrādes rezultātā ir izpildīts galvenais uzdevums- izstrādāti konkrēti likuma grozījumu projekti Zemesgrāmatu likumā un Civillikumā.

The essence of the problem is the situations when in practice in the process of inheriting a deemed part of the immovable property the rights of inheritance of the new joint holder can be limited without reason. The aim of the research is to recognize the cases when in author’s opinion these rights have been limited the most notably and, by doing so, to promote a discussion and to find solutions to this problem. The goal of the research is to find the solutions to the recognized cases by providing specific proposals for amendments of law. The research reaches its goal – it introduces specific amendments in the draft plan for the Land Register Law and the Civil Law.
