Satversmes tiesas sprieduma pārvarēšana: teorētiskie un praktiskie aspekti

Abstract

Sabiedrībā aktuāls kļuvis jautājums par likumdevēja tiesībām pārvarēt Satversmes tiesas spriedumu, no tā izrietošajām sekām un šādas rīcības atbilstību demokrātiskai tiesiskai valstij. Pētījuma mērķis ir izpētīt Satversmes tiesas un tās sprieduma nozīmi demokrātiskā tiesiskā valstī, konstitucionālās tiesas spriedumu raksturojošas pazīmes, kā arī teorētiskās un praktiskās Satversmes tiesas sprieduma pārvarēšanas iespējas. Iegūtie rezultāti norāda uz atsevišķiem trūkumiem likumdevēja rīcībā. Pētījumā sniegti priekšlikumi šo trūkumu novēršanai.

The issue of the legislator's right to overcome the judgment of the Constitutional Court, the consequences thereof and the compliance of such an action with a democratic state governed by the rule of law has become topical in the society. The aim of the research is to study the significance of the Constitutional Court and its judgment in a democratic state governed by the rule of law, the characteristics of the judgment of the Constitutional Court, as well as the theoretical and practical possibilities of overcoming the judgment of the Constitutional Court. The obtained results indicate certain shortcomings in the action of the legislator. The study makes suggestions to address these shortcomings.
