Personāla nodarbinātības jautājumu problemātika valsts dibinātās augstskolās

Abstract

Bakalaura darbā „Personāla nodarbinātības jautājumu problemātika valsts dibinātās augstskolās” tiek analizēts valsts dibināto augstskolu dažādu personāla grupu – akadēmiskā personāla, administratīvā personāla un koleģiālo pārvaldes institūciju locekļu – ievēlēšanas vai iecelšanas lēmumu un nodarbinātības attiecību regulējums. Aplūkojot nacionālo un ārvalstu regulējumu, aktuālo publiski pieejamo tiesu praksi un doktrīnas atziņas, autors secina, ka gan starp dažādām valsts dibinātas augstskolas personāla grupām, gan to ietvaros pastāv nevienlīdzīgs regulējums, kas vienām personām paredz plašākas tiesības nekā citām. Konstatētās problēmas būtu risināmas, veicot grozījumus ārējos normatīvajos aktos, šis process daļēji jau ir uzsākts.

The bachelor’s thesis “Problems regarding staff employment issues in state founded higher education institutions” analyses the regulation of decisions on election or appointment and employment relations of different groups of staff – academic staff, administrative staff and members of collegial administrative institutions – of state founded higher education institutions. Looking at national and foreign regulation, current publicly available case law and doctrinal insights, the author concludes that there is unequal regulation between and within different groups of staff of state founded higher education institutions, which gives some people more rights than others. The problems identified should be addressed by amendments to external laws and regulations, this process has already been partially initiated.
