Laulības noslēgšana un laulības bezstrīdus šķiršanas lietu vešana notariātā, ar to saistītie problēmaspekti

Abstract

Bakalaura darbs „Laulības noslēgšana un laulības bezstrīdus šķiršanas lietu vešana notariātā, ar to saistītie problēmaspekti” sniedz ieskatu laulības slēgšanas un šķiršanas vēsturiskajā attīstībā un regulējumā, iespējamajā laulības slēgšanā pie notāra un laulības bezstrīdus kārtībā šķiršanā notariātā un ar to saistītajiem problēmaspektiem. Darba mērķis ir izpētīt notariāta darbību un lomu laulības slēgšanas un šķiršanas lietās, kā arī apskatīt problēmjautājumus, ar kuriem notāri saskarās laulības šķiršanā un ar kuriem nāktos saskaties laulības slēgšanā. Darba ietvaros autore veic izpēti laulības institūta vēsturiskajā attīstībā, konstatē faktus, kāpēc laulība ir jāslēdz, un nepilnības laulības šķiršanai notariātā tiesiskajā regulējumā, piedāvājot iespējamos risinājumus šo trūkumu novēršanai. Pētījuma rezultātā autore secina, ka ir nepieciešams veikt grozījumus normatīvajos aktos saistībā ar laulības slēgšanas fukciju piešķiršanu notāram. Aizstāvēšanā iekļauto tēžu skaitā autore definējusi laulības jēdzienu un izteikusi priekšlikumus saistībā ar laulības slēgšanas funkciju piešķiršanu notāram.

The bachelor’s work “Conclusion of marriage and holding of no contestation divorce cases in the notariate, and problem aspects connected with them” gives an outlook into historical development and regulation of marriage conclusion and divorce, possible conclusion of marriage at the notary’s and no contestation divorce in the notariate, and problem aspects connected with them. The aim of the present work is to study the activity and role of notariate in the cases of marriage conclusion and divorce, as well as to see the problem issues viewed by the notaries in the divorce procedure and the ones that would be viewed during the marriage conclusion. The author of the present work has studied historical development of the matrimony, stated the facts why the marriage should be concluded, and the drawbacks in the legal procedure of divorce in the notariate, proposing possible solutions for the elimination of these drawbacks. As a result of the study the author has come to the conclusion that it is necessary to make amendments to the normative acts connected with delegating the functions of marriage conclusion to the notaries. In the thesis for the presentation of work the author has included the definition of marriage concept and has presented the proposals regarding the delegation of marriage conclusion functions to the notaries.
