Krāpšana digitālajā vidē

Abstract

Saistībā ar moderno tehnoloģiju attīstību un digitālās vides izmantošanu un pielietojumu personu ikdienas dzīvē, krāpšanas gadījumu skaits digitālajā vidē katru gadu pieaug. Krāpšana jau izsenis ir bijis viens no populārākajiem noziedzīga nodarījuma veidiem. Izmantojot digitālās vides iespējas, krāpnieki spēj izveidot un īstenot jaunus krāpšanas veidus un shēmas, kā rezultātā tiek apkrāpts liels skaits cilvēku, kas ikdienā izmanto modernās tehnoloģijas. Bakalaura darba mērķis ir veikt krāpšanas veidu digitālajā vidē izpēti, lai izprastu, kā krāpnieki iegūst personu uzticību un īsteno prettiesiskās darbības, iegūstot citu personu mantu vai tiesības uz to. Pirmajā darba nodaļā autore aplūkos krāpšanas vēsturisko attīstību, īpašu uzmanību pievēršot krāpšanas institūta attīstībai Latvijas teritorijā no 19.gadsimta līdz 20.gadsimtam. Otrajā darba nodaļā autore veiks krāpšanas kā noziedzīga nodarījuma sastāva analīzi, savukārt darba trešajā nodaļā padziļināti tiks izpētīti tādi krāpšanas veidi digitālajā vidē kā pikšķerēšana, investīciju krāpšana, krāpnieciska veida vēstules un “ātro kredītu” izkrāpšana. Bakalaura darba ietvaros izdarīti vairāki secinājumi, kas norāda uz krāpšanas kā noziedzīga nodarījuma kvalifikācijas īpatnībām, kas veikti digitālajā vidē. Tieši personu vieglprātība saistībā ar savu personu datu nodošanu trešajām personām rada labvēlīgu vidi krāpniecisku darbību īstenošanai. Jānorāda, ka krāpnieki izmanto gan dažādus ietekmēšanas līdzekļus, gan uzdodas par sabiedrībā zināmiem uzņēmumu vai iestāžu darbiniekiem, lai prettiesiski iegūtu un izmantotu personu datus krāpniecisku darbību veikšanai.

In the context of the development of modern technologies and the use of the digital environment in people's daily lives, the number of fraud cases in the digital environment is increasing every year. Fraud has been one of the most popular types of crime. Using the opportunities of the digital environment, fraudsters are able to create and use new forms and schemes of fraud, which results in the defrauding of large numbers of people who use modern technology on a daily basis. The aim of the bachelor's thesis is to conduct research into ways of fraud in the digital environment in order to understand how fraudsters gain the trust of individuals and pursue illegal activities by acquiring other peoples’s property or rights to it. In the first chapter the author will look at the historical development of fraud, paying particular attention to the development of the fraud institute in Latvia from the 19th century to the 20th century. In the second chapter of the work, the author will analyze the composition of fraud as a criminal offence, while the third chapter of the work will explore in depth the types of fraud in the digital environment such as phishing, investment fraud, fraudulent letters and “quick loan” scams. Within the research of the bachelor’s thesis, several conlusions have been made, which indicate the peculiarities of the qualification of fraud as a criminal offence carried out in the digital environment. It is light-mindedness of individuals to transfer their personal data to third parties that creates a favourable environment for the implementation of fraudulent practices. It should be noted that fraudsters use various means of influence and impersonate themselves like employees of well-know companies or institutions in order to unlawfully obtain and use personal data for fraudulent activities.
