Komercnoslēpuma aizsardzības regulējums Latvijā

Abstract

Maģistra darbs „Komercnoslēpuma aizsardzības regulējums Latvijā” sniedz ieskatu komercnoslēpuma jēdziena izpratnes un komercnoslēpuma aizsardzības regulējuma problēmās Latvijas tiesību sistēmā, salīdzinot ar regulējumu ārvalstīs, starptautiskajās tiesībās, kā arī plānoto Eiropas Savienības regulējumu komercnoslēpuma aizsardzības nodrošināšanai iekšējā tirgū. Darbs ir sadalīts trīs nodaļās, sākot ar komercnoslēpuma attīstību un regulējumu ārvalstīs, turpinot ar komercnoslēpuma jēdziena analīzi, pievēršot uzmanību komercnoslēpuma pazīmēm, un beidzot ar komercnoslēpuma aizsardzības īstenošanas regulējuma problēmu analīzi attiecībā uz komercnoslēpuma subjektu, tiesību uz komercnoslēpumu saturu, kā arī tiesiskās aizsardzības līdzekļiem. Darba noslēgumā izvirzīti secinājumi un priekšlikumi attiecībā uz nepieciešamajām izmaiņām tiesību aktos.

Master’s thesis „Regulation on trade secret protection in Latvia” provides an insight on understanding of a concept of trade secrets and challenges of legal framework in Latvia for their protection by comparing it with the legal framework in foreign countries, international law as well as with the proposed legislation of European Union for protection of trade secrets within the internal market. Thesis consists of three main chapters, starting with developments of trade secrets and legal frameworks in foreign countries, continuing further with analysis of the concept of trade secrets by drawing particular attention to the mandatory features of trade secrets, and ending with analysis of framework for protection of trade secrets as regards the holder of trade secrets, contents of a right to trade secret as well as remedies. Thesis is concluded by main findings and proposals with respect to the necessary amendments to the laws.
