Bērna intereses un ārpusģimenes aprūpe Latvijā

Abstract

Darba “Bērna intereses un ārpusģimenes aprūpes Latvijā” mērķis ir izpētīt ārpusģimenes aprūpes sistēmas un politikas atbilstību bērna interesēm. Šī problemātika tiek risināta analizējot normatīvos aktus, politikas dokumentus un tiesu spriedumus. Bērna galvenā interese un lielākā vajadzība ir piesaiste pie kāda pieaugušā, kas viņam sniedz atbalstu un patvērumu, kā arī stabilitāte un pēctecība. Parasti šo funkciju pilda vecāki, tomēr, ja notiek vardarbība pret bērnu un viņu jāizņem no ģimenes, iestāžu galvenais uzdevums ir atrast bērnam vecāka atvietotāju. Bērna intereses gan ir noteiktas kā prioritāras, tomēr praksē vairāk ievēro pieaugušo tiesības, netiek ņemtas vērā bērna vajadzības pēc vismaz vienas piesaistes personas, stabilitātes un pēctecības. Lai bērna intereses patiesi būtu prioritāras, jāgroza likumus un jāceļ atbildīgo amatpersonu kompetence.

“The best interests of the child and out of home care in Latvia” clarifies how the out of home care system and policies meet the needs of a child. This problem is discussed analyzing legislative acts, political documents and court decisions. The overall main interest of a child is the need of attachment to at least one person, who provides support and shelter, stability and continuity. Normally a childes parents carry out this function. Yet, if the child is maltreated and has to be removed from the family the main duty of the authorities is to find somebody who can replace the parents. The best interests of the child are a priority although in life most often the rights of adults are considered. The needs of the child of attachment, stability and continuity are not recognized. The law has to be changed and the competences of the officials have to be increased if the best interests of a child really are to be a priority.
