Seksuālās vardarbības kriminoloģiskās problēmas

Abstract

Seksuālā vardarbība ir noziegums pret personas dzimumneaizskaramību, tādejādi nodarot ilgtermiņa kaitējumu cietušās garīgai, fiziskai un seksuālajai veselībai un nodarot kaitējumu sabiedrībai kopumā, jo garīgi un fiziski vesela persona ir veselas sabiedrības garants. Darba mērķis ir izzināt seksuālās vardarbības būtību visos tās aspektos, tas ir, izzināt kas jurisprudencē tiek izprasts ar jēdzienu seksuālā vardarbība, seksuālās vardarbības sekas (tiesiskās, medicīniskās, sociālās), galvenie faktori, kas ir pamatā nozieguma izdarītāja rīcībai un kādi ir preventīvie pasākumi seksuālās vardarbības novēršanai. Autore secina, ka ikvienas personības attīstības pirmsākums ir bērna un viņa vecāku savstarpējās attiecības. Vardarbība, vienaldzība, naidīgums, noliedzoša attieksme pret bērnu no vecāku puse (it īpaši mātes) ir veicinošie apstākļi personības deformētajā attīstībā.

Sexual abuse is the crime against the sexual inviolability of a person inflicting a long – term damage to the mental, physical and sexual health of a victim and thus hurting the society in general as the mentally and physically healthy person is the guarantor of the healthy society. The aim of the thesis is to explore the essence of the sexual abuse in all of its aspects, that is, to understand how the law interprets the concept of the sexual abuse, what are the legal, medical and social consequences of the sexual abuse, what are the major factors that contribute to the actions of the perpetrator of the crime and what are the preventive measures to preclude the sexual abuse. The author concludes that the prime origin in the development of each personality lies with the mutual relationship between the child and his parents. Violence, indifference, hate and negative attitude of parents, and especially the mother, towards the child are conducive to the deformed development of the personality.
