Tieslietu padomes loma tiesu varas stiprināšanā

Abstract

Darba mērķis ir izprast Tieslietu padomes lomu tiesu varas atzara neatkarības stiprināšanā. Izvirzītā mērķa sasniegšanai darbā risināmi šādi uzdevumi – izpētīt Tieslietu padomes nozīmi un tās efektivitāti, izvērtēt Latvijas Tieslietu padomes modeļa atbilstību Eiropas Savienības rekomendācijām, izpētīt Tieslietu padomes darbības pamatus citās valstīs. Pētījuma rezultātā autore secina, ka tiesnešu karjeras virzība (pa vertikāli) būtu nododama Tieslietu padomes pilnā pārziņā, Saeimas ziņā atstājot lemšanu par tiesnešu iecelšanu un atcelšanu. Turklāt būtu paplašināms to jautājumu loks, par kuriem būtu nepieciešams Tieslietu padomes saskaņojums, ne tikai viedoklis.

The objective is to understand the judicial council of the judiciary's role in strengthening the independence of the branches. To achieve this objective the work addressed the following tasks - to explore the role of the Judicial Council and its effectiveness, evaluate the Latvian Council of Justice of the European Union model to meet the recommendations of the Judicial Council to examine the foundations of other countries. The author concludes that judges career patterns (vertical) would be a candidate for the full charge of the Judicial Council, the Parliament leaving the judges deciding on the appointment and removal. It would be also expanded range of issues, which would have required the Judicial Council ordination, not just opinion.
