Pašvaldības uzdevumu izpildes nodošana privātpersonām

Abstract

Šī pētījuma nolūks ir izpētīt iespējas, kā pašvaldību uzdevumi var tikt nodoti komercsabiedrībām. Pašvaldību uzdevumu nodošana komercsabiedrībām Latvijā ir regulēta ar normatīvajiem tiesību aktiem. Arī praksē ir sastopami gadījumi, kad pašvaldības nodod to kompetencē esošus uzdevumus komercsabiedrībām. Tomēr normatīvajos tiesību aktos ir noteikta un arī praktiski šāda uzdevumu nodošana notiek dažādās formās.

The objective of this master’s thesis is to evaluate the possible ways of transfer of municipal tasks to private and municipal owned companies. The thesis begins with a survey of activities of municipality in the sphere of private law. Here the provisions of the State Administration Structure Law are evaluated and a conclusion is drawn that certain amendments in law are desirable as the difference between municipal activity in providing public services and municipal commercial activity in not clear.
