Darba koplīgums darba tiesiskajās attiecībās

Abstract

Latvijā nepastāv vienotas teorētiskas izpratnes par darba koplīgumu juridisko būtību. Tas nereti noved pie atšķirīgas tiesību normu interpretācijas. Bakalaura darba mērķis ir izpētīt darba koplīguma teorētiskos aspektus, sākot veidot darba koplīguma teoriju Latvijā un apskatīt vairākus praktiskus problēmjautājumus. Latvijas darba koplīguma izpratne ir balstīta uz Vācijas tiesību doktrīnu, tādēļ autore plaši izmanto salīdzinošo metodi, noskaidrojot būtiskus līdz šim neapskatītus jautājumus Latvijā. Tāpat darba izpētē tiek izmantota arī analītiskā, vēsturiskā un deduktīvā metode. Autore noskaidro darba koplīguma juridiskās būtības izpratni Latvijā un veido darba koplīguma teoriju. Vairāki problēmjautājumi analizēti likuma komentāra stilā, lai tos varētu piemērot arī praksē.

In Latvia, there is no generally accepted theoretical understanding regarding the legal essence of the collective agreement. As the consequence, there are occasional occurrences of conflicting interpretations of the legislative provisions governing the matter. This bachelor thesis paper seeks to contribute to laying a basis for legal theory regarding the collective agreement by addressing the theoretical aspects of the matter and addressing a number of practical problem issues. The Latvian understanding of the collective agreement is largely based on the German legal doctrine. Therefore, the author of this paper is to apply the comparative research method widely, thus addressing a few essential issues not academically researched in Latvia until now. Likewise, the analytical, historical and deductive research methods are to be employed for the purposes of this paper.
