Briseles Ibis regula - tieša un netieša pušu vienošanās par jurisdikciju

Abstract

Briseles I bis regulā ir iekļauti divi iespējamie veidi, kā puses var noslēgt spēkā esošu vienošanos par jurisdikciju, tādā veidā realizējot pušu autonomiju. Proti, gan tieši slēgta vienošanās, ko regulē 25. pantā noteiktais, gan netieši, ko, savukārt, regulē 26. pants. Ņemot vērā to, ka ir dažādi gan regulā, gan tiesu praksē noteikti kritēriji, lai šādas vienošanās būtu spēkā esošas, ir nepieciešams aplūkot kuros gadījumos piemērosies Eiropas Savienības normas un kuros nacionālās normas. Papildus tam, tā kā šīs vienošanās puses slēdz patstāvīgi, ir nepieciešams aplūkot arī kritērijus, kas ierobežo to izvēli vai tieši otrādāk – paplašina veidus kādos var slēgt šādas vienošanās. Bakalaura darba ietveros tiek aplūkoti dažādi kritēriji, lai vienošanās par jurisdikciju tiktu uzskatītas par spēkā esošām, kā arī tiek rasti risinājumi situācijām, kuras Regulas patreizējais regulējums vēl neaptver vai arī tas ir nepilnīgs.The Brussels I bis Regulation, as an expression of parties autonomy, defines two possible ways on how to conclude a valid agreement on jurisdiction. Specifically, both direct agreements, which are regulated by Article 25, and indirect agreements, which, in turn, are regulated by Article 26. Considering that there are different ciretia for the validty of these type of agreement both in regulation and court practice, it is neccesary to determine in which cases the European Union norms will be applied and in which national norms. Moreover, as these agreements are concluded by parties independently, it is also important to examine the cirteria that limit or, conversely, expand the ways that in which these type of agreements can be made. Within the scope of this bachelor’s thesis, various criteria are examined for such agreement to be considered valid, as well as solutions are found for situations that the current regulation does not yet cover or where it is incomplete.
