Arheoloģiskā mantojuma tiesiskās aizsardzības aktuālie jautājumi

Abstract

Latvijā arheoloģiskie pieminekļi ir sastopami visā teritorijā, taču bieži arheoloģiskais mantojums nav vizuāli uztverams. Nelielā sabiedrības informētība par arheoloģiskajām vērtībām un infrastruktūras attīstība veicina arheoloģiskā mantojuma bojāeju. Darbā aplūkots, vai apgrūtinājumi, ko uzliek valsts kultūras pieminekļa īpašniekiem, ir samērīgi ar sabiedrības interesēm, kā arī tas, kādi ir arheoloģiskā mantojuma apdraudējumi, īpašnieku pienākumi un tiesības un tas, kā valsts sabalansē abas šīs kategorijas. Darba gaitā sniegti priekšlikumi par nepieciešamajiem uzlabojumiem arheoloģiskā mantojuma aizsardzībā, piemēram, būtiskāk par bargāku sodu ieviešanu arheoloģiskā mantojuma postītājiem ir veikt sabiedrības izglītojošus pasākumus un pastiprināt arheoloģisko pieminekļu uzraudzību.

Latvian archaeological monuments are found throughout the country evenly, but in many cases archaeological heritage is not clearly visible. The small public awareness of archaeological values and urban infrastructure development promote the destruction of archaeological heritage. Considering the higher, the thesis examines whether the lien imposed by the state to the owners of monuments, are proportionate to the public interest, and the threats to the archaeological heritage, and ownership rights and obligations. The objectives of the thesis is to propose improvements in protecting the archaeological heritage. For example, it is more important to make public educational activities than increase penalties for destroying of the archaeological heritage, and to find cooperation between archaeologists and users of metal detectors.
