Saskarsmes tiesību tiesiskie un praktiskie aspekti

Abstract

Vecākiem šķiroties ir būtiski nodrošināt, ka bērns saglabā ciešas attiecības, ne tikai ar abiem vecākiem, bet arī ar citām bērnam nozīmīgām personām. Darba mērķis ir izpētīt saskarsmes tiesību normatīvo regulējumu un tā īstenošanu praksē. Darba uzdevumi ir izpētīt saskarsmes tiesību jēdzienu, būtību un vēsturisko attīstību, saskarsmes tiesību noteikšanas kārtību, kā arī saskarsmes tiesību nolēmuma īstenošanas un piespiedu izpildes problemātiku. Pētījuma rezultātā ir ierosināts veikt grozījumus Latvijas Republikas Civillikumā, Civilprocesa likumā un Mediācijas likumā.

When parents separate, it is essential to ensure that the child maintains close relationships not only with both parents but also with other persons significant to the child. The aim of the thesis is to examine the legal regulation of contact rights and their implementation in practice. The tasks of the thesis are to explore the concept, essence, and historical development of contact rights, the procedure for determining contact rights, as well as the challenges of enforcing and executing court decisions regarding contact rights. As a result of the research, amendments to the Civil Law of the Republic of Latvia, the Civil Procedure Law, and the Mediation Law are proposed.
