Kriminālprocesā aizskartā mantas īpašnieka statuss, tiesību un pienākumu apjoms

Abstract

Aizskartā mantas īpašnieka statuss mūsdienās nav plaši pētīts, tādēļ ar šī maģistra darba palīdzību tiek izprasta aizskartā mantas īpašnieka statusa būtība, apzināta tā statusa iegūšana un zaudēšana, kā arī apskatīts tā tiesību un pienākumu apjoms, salīdzinot ar citiem procesa dalībniekiem. Ņemot vērā, ka aizskartā mantas īpašnieka statuss ir maz pētīts, tā piemērošanai un ikdienas pielietošanai ir neskaitāmas nepilnības, kuras tiek apskatītas un analizētas šī darba ietvaros. Turklāt tiek piedāvāti priekšlikumi problemātikas novēršanai.

The status of owner of infringed property is not widely studied nowadays, therefore with the main purpose of the master’s thesis is to research the meaning of the status of owner of infringed property, to understand acquisition and loss of its status, and the extent of its rights and obligations compared to other participants of the process. Considering that the status of owner of infringed property is not widely studied, its application and daily use have numerous shortcomings that are taken into account and analysed within this work. In addition, the author offers suggestions for problem solving.
