Šaujamieroči un to pielietošana pašaizsardzībā

Abstract

Katrai fiziskai personai ir tiesības aizsargāt savu vai citu personu tiesības un likumiskās intereses prettiesiska apdraudējuma gadījumā. Fiziskām personām, kuras spēj izpildīt normatīvajos aktos noteiktās prasības, ir tiesības pielietot šaujamieročus, ievērojot šaujamieroču pielietošanas nosacījumus. Pētījums ir vērsts uz literatūras, normatīvo aktu un tiesu prakses izpēti, lai nepieciešamās aizstāvēšanās tiesisko regulējumu varētu efektīvāk piemērot. Izmantotas dažādas pētnieciskās metodes, lai visaptveroši izvērtētu dažādus šaujamieroču veidus, atklātu atšķirības pašaizsardzības un nepieciešamās aizstāvēšanās tiesiskajā regulējumā. Autors bakalaura darbā sniedz secinājumus un priekšlikumus, kā arī, lai saskaņotu tiesisko regulējumu, tiesību normas izsaka jaunā redakcijā.

Every natural person has the right to defend his or her rights and legal interests of other persons in the case of an unlawful threat. Natural persons who are able to meet the requirements specified in regulatory enactments has the right to use firearms, subject to the conditions of the using of firearms. The study focuses on literature, laws and the reaserch of case law so that the legal framework of necessary defence, could be effectively applied. Different research methods have been used to comprehensively evaluate different types of firearms, to detect differences in the legal framework of self-defence and in necessary defence. Author in the bachelor’s thesis formulate conclusions and proposals, as well as to harmonise legal framework the provision has to be expressed in the new version.
