Valsts valoda augstākajā izglītībā un zinātnē: problemātiskie aspekti

Abstract

Augstākajai izglītībai un zinātnei ir neatsverama loma valsts valodas attīstībā. Valsts valodas aizsardzības nolūkos likumdevējs ir centies nostiprināt valsts valodas lietošanu visos izglītības līmeņos. Taču vairāki Satversmes tiesas spriedumi par Augstskolu likuma normu atbilstību Satversmei liecina, ka likumdevējs, centienos nostiprināt valsts valodas lietojumu studiju programmās, ir pārlieku iejaucies augstskolu autonomijā. Papildus tam, valsts valodas loma studiju programmu īstenošanā ir stingri regulēta gan studiju programmu, gan to īstenojošo mācībspēku jomā, savukārt zinātniskajā darbībā valsts valodas lietojums tiek regulēts minimāli, un spēkā esošais regulējums veicina zinātnisko publikāciju izstrādi svešvalodās. Maģistra darba mērķis ir izpētīt valsts valodas lietojuma augstākajā izglītībā un zinātnē problemātiskos aspektus, lai varētu piedāvāt risinājumus, kas līdzsvarotu valsts valodas aizsardzību ar augstskolu autonomiju un akadēmisko brīvību.

Higher education and science play an important role in the development of the state language. To protect the use of state language in Latvian society, the legislator has tried to strengthen the use of state language in all levels of education system. However, several judgements of the Constitutional court of Latvia on the compliance of the provisions of the Law on Higher Education Institutions with the Constitution of Latvia show that the legislator, while trying to strengthen the use of the state language in study programs, has excessively interfered in the autonomy of universities. In addition to that, the role of the state language in the implementation of study programs is strictly regulated in terms of study programs and regarding the requirements for the academic staff, while in field of scientific activities the use of state language is minimally regulated and current regulation promotes writing of scientific publications in foreign languages. The aim of this thesis is to examine in more detail the problematic aspects of the use of state language in higher education and science and find solutions to the discovered problems, which would balance the protection of state language with the academic freedom and autonomy of universities.
