Abstract
Darba tēma ir „Administratīvo pārkāpumu lietu izskatīšanas reforma”. Kā viens no
reformas iemesliem ir administratīvo pārkāpumu krimināltiesiskais raksturs. Eiropas
Cilvēktiesību tiesa un Eiropas Cilvēktiesību komisija administratīvo pārkāpumu lietas iedala
tādās, kuras ir pielīdzināmas krimināllietām un tādās, kuras nav. Minētais dalījums ir ļoti
būtisks, jo no tā atkarīgas procesuālās garantijas, kas atbilstoši Eiropas Cilvēktiesību un
Pamatbrīvību aizsardzības konvencijai nodrošināmas tiesas procesā iesaistītajām personām.
Lai izprastu administratīvo pārkāpumu lietu krimināltiesisko raksturu, darbā aplūkota
administratīvo pārkāpumu lietu būtība, Latvijas Republikas tiesu un Eiropas Cilvēktiesību
tiesas prakse, kā arī Eiropas Cilvēktiesību komisijas atzinumi. Eiropas Cilvēktiesību tiesas
prakses un Eiropas Cilvēktiesību komisijas atzinumu izpētes rezultātā, konstatēti tie kritēriji,
kuri norāda uz administratīvā pārkāpuma krimināltiesisko raksturu.
Darba rezultātā izdarīti secinājumi par procesuālajām garantijām, kas nodrošināmas,
izskatot administratīvo pārkāpumu lietu tiesā, aplūkots Latvijas Administratīvā pārkāpumu
kodeksa un Administratīvā procesa likuma regulējums, nosakot trūkumus un problēmas
administratīvo pārkāpumu lietu izskatīšanas tiesiskajā regulējumā.
Secinājumu daļā doti vairāki ierosinājumi konstatēto problēmu risināšanai.
Bachelor’s Paper “Reform of proceedings on administrative violations.” One of reasons for the reform is the criminal nature of administrative violations. The European Court of Human Rights and the European Commission of Human Rights divide administrative violation cases into those placed on the same level as criminal cases and those who lack this aspect. Aforesaid division is very important since procedural safeguards depend on it that according to the European Convention for the Protection of Human Rights and Fundamental Freedoms are to be provided for the persons involved in the proceedings. In order to understand the criminal nature of administrative violations the Paper examines the nature of administrative violations, practice of the courts in the Republic of Latvia and the European Court of Human Rights as well as opinions of the European Commission of Human Rights. According to the conclusions made from research of practice of the European Court of Human Rights and the European Commission of Human Rights author has established criteria indicating at the criminal nature of administrative violations. Conclusions have been drawn about the procedural safeguards which are to be provided upon reviewing the administrative violation in the court, legal order of the Latvian Administrative Violations Code and the Administrative Procedure Law are reviewed by identifying the deficiencies and problems in legal order of proceedings on administrative violations. There are several recommendations in tackling the spotted problems in the Conclusions section.
