Paternitātes atzīšana un apstrīdēšana.

Abstract

Bakalaura darba “Paternitātes atzīšana un apstrīdēšana” mērķis ir sniegt ieskatu paternitātes brīvprātīgas atzīšanas un tās apstrīdēšanas teorētiskajā analīzē, tiesu praksē, regulējumā, kā arī piedāvāt likumu grozījumus paternitātes atzīšanas problemātikas risināšanai. Darba ietvaros autore apskatīja paternitātes atzīšanas teorētisko, vēsturisko aspektu un procesa norises gaitu Latvijā. Autore apskatīja paternitātes atzīšanas tiesisko regulējumu gan Eiropas Savienības valstīs, gan valstīs ārpus tās, veicot ārvalstu un Latvijas regulējuma salīdzinājumu. Darbā tika apskatītas paternitātes atzīšanas tiesiskās sekas, kā arī brīvprātīgi atzītas paternitātes apstrīdēšanas iespējas.

The aim of the bachelor’s thesis “The recognition and appeal of paternity” is to provide an insight into the theoretical analysis of the subject, case law, regulation as well as to propose amendments to the law in solving the issues of recognition of paternity. Within the work author researched the theoretical and historical aspect of the recognition of paternity, as well as the process in which it happens in Latvia. Author examined the legislative framework of recognition of paternity within and outside the European Union, performing a comparison of foreign and Latvian regulations. Within the work author researched legal consequences of recognition of paternity and the possibilities to appeal paternity that has been recognised.
