dc.description.abstractThe thesis is aimed to determine whether the investor-state dispute settlement system is biased in favour of investors through the analysis of Arbitration Rules laid down in the ICSID Convention and UNCITRAL and the corresponding case law. The research focuses on state counterclaims in treaty-based arbitration, since it is a relatively new and problematic phenomenon that has triggered a lot of criticism and drawn the attention of many scholars to the issue.en_US
