Abstract
Kriminālprocess ir tiesību normu kopums, kurā noteikta procesuālā kārtība no kriminālprocesa uzsākšanas brīža līdz iztiesāšanas pabeigšanai. Noziedzīgus nodarījums izdara konkrētas personas un viņu vainas pierādīšanai būtiskākais aspekts ir pierādījumu iegūšana un to nostiprināšana atbilstoši Kriminālprocesa likumā noteiktajam. Pētījuma mērķis ir izpētīt pieļaujamības normatīvo regulējumu un sniegt vērtējumu par Kriminālprocesa likuma 130. panta piemērošanu praksē. Pētījuma rezultātā ir izveidojies praktisks priekšstats par kritērijiem, kas ir būtiski, nošķirot procesuāli pareizi iegūtus pierādījumus no neizmantojamiem pierādījumiem, kas iegūti neievērojot kriminālprocesa pamatprincipus. Vienlaikus autors darbā sniedz savu subjektīvo vērtējumu un izpratni par pierādījumu iegūšanas problemātiskajiem aspektiem.
Criminal procedure is a set of legal rules that establishes the procedural order from the opening of criminal proceedings to the conclusion of the trial. Crimes are committed by specific individuals and the most important aspect of proving their guilt is obtaining evidence and establishing it in accoradance with the Criminal Procedure Law. The aim of the study is to examine the normative framework of admissibility and to provide an assessment of the application of Article 130 of the Criminal Procedure Law in practice. The study has led to a practical understanding criteria that are relevant in distinguishing between procedurally correct evidence and unusable evidence obtained in violation of the basic principles of criminal procedure. At the same time, the author provides his subjective assessment and understanding of the problematic aspects of obtaining evidence.
