Intelektuālais īpašums un mūzikas darba publiskošana Eiropas Savienībā

Abstract

Bakalaura darbs vērsts uz Intelektuālā īpašuma, galvenokārt, autortiesību un blakustiesību izpēti Eiropas Savienībā, kā arī uz mūzikas darbu publiskošanu un iespējamām grūtībām saistībā ar šī termina interpretāciju un pielietošanu praksē. Darbā plaši aplūkota Eiropas Savienības Tiesas prakse, kas skar autortiesības un blakustiesības, pamatā attiecoties uz šo tiesību subjektu darbu publiskošanu. Autors darbā salīdzinājis atšķirīgās jēdziena „publiskošana” interpretācijas un pielietojumu praksē, kā arī apskatījis Latvijaskolektīvā pārvaldījuma organizāciju rīcību atbilstību normatīvajiem aktiem un Eiropas Savienības Tiesas spriedumiem.

This bachelor thesisfocuses on the research ofintellectual property, mainly on copyright and related rights, in the EuropeanUnion. It has also considered the publication of musical works and possibledifficulties in this term’s interpretationand applicationin practice. In this workthere has been widelydiscussedthe practice of the European Union Court of Justice which concerns copyright and related rights, based on the subjects of these rights and the publication of their works. The authorhas also compared thedifferentapproaches for the processes of interpretation and application in practice of the term"publication” and there has also considered the accordance to the laws and regulations and the judgements of the European Union Court of Justice of the organizations of the Collective Government of Latvia.
