Latvijas Republikas Augstākās tiesas darba organizācijas un struktūras vēsture

Abstract

Bakalaura darba mērķis bija izpētīt Augstākās tiesas vēsturi, proti, Senāta izveidi, tā tiesisko mantojumu, senatoru personības, departamentu sastāvu, Senāta likvidēšanu un atjaunošanu, Senāta struktūras un likumdošanas izmaiņas pastāvot Latvijas Republikai. Darba pirmā nodaļa satur Krievijas impērijas Senāta uzbūves raksturojumu, kas bija pamats Latvijas Republikas pirmajam Senātam. Otrā nodaļa satur Latvijas Republikas pirmā Senāta vēsturi no 1918.gada līdz 1940.gadam. Trešā nodaļa satur 1995.gada izveidotā Senāta vēsturi. Autore darbā konstatē to, ka – abiem pastāvošajiem Augstākās tiesas Senātiem struktūras pamati daļēji tika ņemti no iepriekšējā valdošā režīma; 1995.gadā dibinātajam Senātam pirmajā sastāvā bija daudz lielāks tiesnešu skaits nekā starpkaru Senātā, kas varētu būt izskaidrojams ar augstākās izglītības pieejamību.

The aim of the bachelor's thesis was to study the history of the Supreme Court, namely the establishment of the Senate, its legal legacy, the personalities of senators, the composition of departments, the dissolution and renewal of the Senate, changes in the structure and legislation of the Senate during the existence of the Republic of Latvia. The first chapter of the work contains a description of the structure of the Senate of the Russian Empire, which was the basis for the first Senate of the Republic of Latvia. The second chapter contains the history of the First Senate of the Republic of Latvia from 1918 to 1940. The third chapter contains the history of the Senate established in 1995. The author notes in her work that - the foundations of the structure of the two existing Supreme Court Senates were partly taken from the previous ruling regime; the first composition of the Senate, founded in 1995, had a much larger number of judges than in the interwar Senate, which could be explained by the availability of education.
