Nosacīta notiesāšana

Abstract

Bakalaura darbs ir vērsts uz nosacītas notiesāšanas institūta izpēti. Galvenokārt tiek aplūkots nosacītas notiesāšanas regulējums tieši Latvijā, taču tiek sniegts ieskats arī citu valstu regulējumā. Autors salīdzina atšķirīgus viedokļus par nosacītas notiesāšanas būtību un skaidro tās juridisko dabu. Darbā tiek aplūkota un analizēta tiesu prakse, kas saistīta ar nosacītas notiesāšanas piemērošanu un ar to saistītajām problēmām. Darbā tiek īpaši uzsvērta tiesas nepietiekošā motivācija, nosakot sodu nosacīti. Autors piedāvā noteikt, ka gadījumā, ja pārbaudes laikā izdarīts jauns noziedzīgs nodarījums aiz neuzmanības, pie noteiktiem apstākļiem tiesa var lemt par pārbaudes laika pagarināšanu, neizpildot nosacīti noteikto sodu.

The bachelor thesis focuses on the research of conditional sentence. It mainly describes the regulation of conditional sentence in Latvian legislation directly, but there are also given an insight into the regulation of other countries. Author compares the different positions of probation and explains the nature of its legal nature. In thesis is discussed and analyzed the case law relating to probation and application problems associated with it. The work is especially emphasized in the court insufficient motivation, when it determines conditional sentence. Author proposes to determine, if person commit another criminal offense during the probationary period and if it is committed through negligence, in certain circumstances court may decide to extend the probationary period, instead of the applying the punishment.
