Apelācijas instances tiesvedības procesa nozīme tiesas spriešanā civillietās

Abstract

Apelācija kā pārsūdzības procedūra nepieciešama personu tiesību aizsardzībai, taču tā saista ne tikai apelācijas instanci, bet ietekmē visas tiesu sistēmas darbību. Nolūkā veicināt efektīvāku tiesas procesa norisi, darbā tiek apskatītas atsevišķu kategoriju lietu izskatīšanas īpatnības apelācijas instancē un izvērtēti ieguvumi apelācijas atļaujas institūta ieviešanai Civilprocesa likumā. Tāpat tiek izzināta apelācijas sūdzības būtība no lietas dalībnieku skatpunkta un aplūkota tās saistība ar apelācijas instances tiesas kompetenci turpmākā lietas izskatīšanā. Izpētes rezultātā autore rosina veikt grozījumus Civilprocesa likumā saistībā ar apelācijas sūdzības iesniegšanai paredzētajiem termiņiem.

An appeal procedure is necessary to protect the rights of individuals, but it affects the functioning of the entire judicial system, not just the appellate court. In order to promote more efficient court proceedings, this thesis examines the peculiarities of separate categories of cases in an appellate court and discusses the benefits of introducing the institution of leave to appeal in the Civil Procedure Law. This thesis also explores the nature of an appeal from the perspective of the parties and its relation to the competence of the appellate court in further proceedings. The author proposes amendments to the Civil Procedure Law in relation to the time limits for lodging an appeal.
