Abstract
Pēc Satversmes tiesas sprieduma, spēku zaudējušie panti par personu rīcībspējas
apjomu atstājuši robu Latvijas likumdošanā, kas šobrīd tiek kontrolēts ar pagaidu regulējuma
palīdzību. Grozījumu pieņemšana nav vienkārša; pirms tiek pieņemts jaunais regulējums, kas
aizvietotu novecojušos Civillikuma pantus ar jaunu, cilvēktiesībām atbilstošu regulējumu
rīcībspējas jomā, rūpīgi jāizvērtē visas problēmsituācijas, kas varētu rasties ieviešot daļējo
rīcībspēju ar atbalstītās lemt spējas institūtu. Svarīgi ir noskaidrot, pēc kādiem kritērijiem
tiesa vadīsies, nosakot tās jomas, kurās persona nevarēs pati darboties, cik plašas izmaiņas
Civillikuma grozījumu ietekmē tiks veiktas citos likumos, un kā plānotais regulējums atbildīs
starptautiskajām prasībām.
After the ruling by Consitutional court a gap has been left in the Latvian legislation by void articles on the amount of capacity of a person, which for now has been filled by a temporary regulation. Adoption of new amendments is not easy, because, before the adoption of new regulations which will take the place of the outdated law, there must be careful evaluation of all the problems that might arise from the implementation of supported decision making and partial capacity institute. It is important to know what criteria the court will be guided by when determining the areas in which that person can’t make desicions for oneself, how the new amendments will affect other laws and if the new regulation will fit international requirements.
