Abstract
Bakalaura darba temats ir ”Notārs kriminālprocesā”. Bakalaura darba mērķis ir izpētīt vai, un, cik lielā mērā notāri tiek iesaistīti Latvijas kriminālprocesā, kāda ir to loma kriminālprocesa uzsākšanā un izlīguma noslēgšanā. Kā problēmjautājumu darba autore izvirza zvērināta notāra konfidencialitātes ievērošanas un imunitātes sasaisti ar spēkā esošajiem normatīvajiem aktiem, kas uzliek notāram par pienākumu liecināt par ar amata noslēpumu saistītiem jautājumiem, kā arī ziņot Noziedzīgi iegūtu līdzekļu legalizācijas novēršanas dienestam (Kontroles dienestam) par aizdomīgiem un neparastiem darījumiem. Bakalaura darba izstrādes gaitā ir izvirzīti būtiski priekšlikumi un, veicot anketēšanu, noskaidrots arī zvērinātu notāru viedoklis par viņiem uzliktajiem pienākumiem un spēkā esošo regulējumu.
The topic of the bachelor thesis is “Notary in criminal proceedings.” The purpose of this bachelor thesis is to research in what way are notaries involved in Latvian criminal proceedings, what is their role in the initiation of criminal proceedings and in reaching a conciliation agreement. The main topic of this reasearch is the notaries responsibility towards confidentiality and its immunity and how these properties interact with the existing laws and regulations which make it the notaries responsibility to give testimony regarding notarial secrets and to report to the Office for Prevention of Laundering of Proceeds Derived from Criminal Activity (FIU Latvia) about unusual and suspicious transactions. This thesis gives essential suggestions and with a survey, the opinions of acting notaries have been gathered regarding their duties and how they are affected by the existing laws and regulations.
