Sacīkstes principa ievērošanu civilprocesā

Abstract

Šis darbs ir par sacīkstes principa ievērošanu civilprocesā, kā arī sacīkstes principa izpausmē un tā pozitīvajām, negatīvajām īpašībām. Pēc autora domām sacīkstes princips ir kā zobens ar divām šķautnēm – pastāvot gan pozitīvajām, gan negatīvajām īpašībām - izceļas tieši tās negatīvās īpašības, kas izriet no pozitīvajiem šī principa aspektiem, kas rada pat zināmu procesa bremzēšanos. Šī darba beigās autors nonāca pie secinājuma, ka darba mērķis ir sasniegts.

This work is about the adversial principle and the way It works, in the civilprocedure, It’s problems, both in the continental and anglo-american legal systems. The author thinks of adversial principle as a two edged sword – having both positive characteristics and also negative - , but on top of that, that the same good qualities hold back the civilprocedings and often slow them down, also the lack of iniciative of the judge. At the end author believes, that he has reached the goals in this work, set out by him.
