Lietas faktiskā sastāva konstatēšana izmantojot netiešos pierādījumus tieslietās

Abstract

Maģistra darbs ir veltīts lietas faktisko apstākļu konstatēšanas, izmantojot netiešos pierādījumus, problēmu analīzei Latvijas tiesu praksē, ņemot vērā gan Latvijas, gan ārvalstu tiesību zinātnieku darbos apskatītajam jautājumam paustās atziņas. Darba struktūru veido trīs nodaļas. Pirmā nodaļa ir veltīta lietas faktisko apstākļu jēdzienam. Darba otrā nodaļā sniegts teorētisks apskats par plašāku darbību kopumu, ko vispārināti var apzīmēt ar pierādīšanu. Trešā nodaļa ir ar praktisku ievirzi – tajā aplūkota pierādīšanas norise tiesā civilprocesā, izmantojot netiešos pierādījumus prasības tiesvedības un sevišķās tiesāšanas kārtībā skatāmajās lietās.

This Master`s Thesis is devoted to problem analysis in Latvia’s judicial practice on the fact detection of the case through indirect evidence, taking into consideration conclusions of Latvian and foreign legal scientists on the studied issue. Structure of the Thesis consists of three chapters. Chapter one is dedicated to the concept of facts of the case. The second chapter of the Thesis provides theoretical overview on wider range of actions that can be generally designated as proving. Third chapter of the Thesis is with a practical guidance – this chapter describes the burden of proof in civil court process using indirect evidence in court proceedings by way of action and in special adjudication procedures.
