Komercnoslēpums kā ierobežotas pieejamības informācija

Abstract

Bakalaura darbā „Komercnoslēpums kā ierobežotas pieejamības informācija” tiek pētīti komercnoslēpuma administratīvi tiesiskie aspekti un piemērošanas problēmas. Komercnoslēpums ir viens no svarīgākajiem uzņēmuma darbības instrumentiem, kas nodrošina uzņēmuma darbību konkurences apstākļos. Tomēr komercnoslēpumam, nonākot iestādes rīcībā, tas kļūst par informāciju, kas, pamatojoties uz Informācijas atklātības likumu, var tikt izpausta trešajām personām. Autore secina, ka Informācijas atklātības likuma tvērumā nošķirama iestādes rīcība ar trešās personas komercnoslēpumu saturošu informāciju no iestādes rīcības ar publiskas personas kapitālsabiedrības komercnoslēpumu. The aim of the Bachelor thesis „Trade secret as a restricted access information” is to explore the administrative aspects as well as application problems of trade secret. Trade secret is one of the most crucial assets of company ensuring its operations in competitive business environment. However, when trade secret reaches authority it becomes the information that could be disclosed to third parties based on Freedom of Information Law. The author concludes that within the Freedom of Information institutional conduct should be distinguished with third parties commercially confidential information from the institutional conduct with public person of the corporation trade secret.
