Bērna tiesības uzaugt ģimenē no starptautisko, Eiropas un Latvijas tiesību viedokļa

Abstract

Bakalaura darbā „Bērna tiesības uzaugt ģimenē no starptautisko, Eiropas un Latvijas tiesību viedokļa” ir konstatētas raksturīgākās bērna tiesību uzaugt ģimenē tiesiskā regulējuma piemērošanas problēmas, un izvērtēta šo problēmu ietekme uz bērnu un viņam garantēto tiesību uz ģimeni nodrošināšanu. Bakalaura darbā autore koncentrējas uz Apvienoto Nāciju Organizācijas (turpmāk tekstā – ANO) Konvenciju par bērna tiesībām, Cilvēktiesību un pamatbrīvību aizsardzības konvencijas (turpmāk tekstā – ECK) 8.panta un nacionālo tiesību aktu analīzi attiecībā uz bērna tiesību uzaugt ģimenē nodrošināšanu un aizsardzību. Darba mērķis ir atklāt ANO un Eiropas Cilvēktiesību sistēmā pastāvošās normatīvās pieejas un praksē izstrādātos principus, kas aizsargā un nodrošina bērna tiesības uzaugt ģimenē, veikt to salīdzinājumu ar Latvijas regulējumu, konstatēt problēmas šo tiesību nodrošinašanā un meklēt tām risinājumu.

Bachelor’s work „Children’s right to grow up in a family of international, European and Latvian law” reveals typical legal framework implementation issues of child’s right to grow up in a family and its effects on children and their right to grow up in a family. The author focuses on the United Nations (hereinafter – UN) Convention on the Rights of the Child, the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter– ECHR) article eight and national legislation on the rights of the child analysis. The aim of the research is to reveal the normative approaches and the principles elaborated in practice in the United Nations and European human rights treaties, which protects and ensure the child’s right to grow up in a family, compare it with Latvian legal framework and practice and identify problems ensuring these rights and look for solutions.
