Speciālo izmeklēšanas darbību norobežošana no operatīvās darbības pasākumiem

Abstract

Darba mērķis ir speciālo izmeklēšanas darbību un operatīvo darbību pasākumu analizēšana, to salīdzināšana un atšķirību izzināšana. Teorētisko un praktisko problēmaspektu konstatēšana, veicot speciālās izmeklēšanas darbības un operatīvās darbības pasākumus, un to atbilstība cilvēktiesību standartiem. Darba uzdevumi ir izpētīt Latvijas Republikas normatīvos aktus un Latvijas Republikai saistošos starptautiskos dokumentus, iepazīties ar Satversmes tiesas un Eiropas Cilvēktiesību tiesas judikatūru. Identificēt trūkumus tiesību aktos un sniegt ieteikumus to pilnveidot, atbilstoši starptautisko standartu noteiktajiem principiem.

The aim of this paper is the analysis of special investigation process and of investigation field work, their comparison and differences. The determination of theoretical and practical problem aspects, managing special investigation processes and investigation field work and their eligibility to human rights standards The objectives of this paper is to study the normative acts of Republic of Latvia and binding international documents of Republic of Latvia, to acquaint with Constitutional court and European Court case law on Human rights. To identify the lack into rights acts and to give suggestions to improve it, according to international standards fixed principles.
